Still. If patriot act does give this type of "authority",that means its been put in US Code.I'm looking for something specific here.Like what section,paragraph, etc, that this authority is located. If there is such authority for a Gestapo like stop I'll be on the phone and in person to fight it.
This is a bad joke at best. We need to know the statute to be able to refute this sortof thing if we are in that situation.
A. Some states have provisions for DUI/DWI "checkpoints". Some states go even further by allowing law enforcement to pursue those who purposely try to avoid said roadblock. So, if there is an impromptu federal roadblock on your way to work,and you try to go around it, you might be stopped anyways.So...
B. We need to know EXACTLY what the law allows for and DOES NOT allow for. So when a FED law enforcement officer steps over the line we know. How can we refute/argue what we don't know?? Besides just saying "thats wrong".
C. You can not fight what you do not know. How would you speak to your elected represenatives about this if you start the discussion by saying "there are temporay fed roadblocks being conducted, and that darn Patriot Act is what gives them the authority".Huh??? If you start by saying that "18 United states code, section blah blah, paragraph blah blah, says blah blah, and here is what I think of it because..." Thats a much more soilid foundation to start from.
I'm not arguing that the event didn't happen. It probably did. I'm just saying that if we want to do more than just be pissed about it we need knowledge.

I have seen several news reports on these kind of road locks/check points and I some YouTube videos where the check point was 50 miles from the border. What I do not know is if anyone has challenged the legality of these road blocks/check points in a court of law.
Zealous agents/agencies and LEO's will often do things that are illegal because either they think they can get away with it or that are sure that whatever they are doing has not been tested in a court of law. You have to figure it this way:
First, if you complain about it, you are either hiding something or asked if you have a problem helping keep our borders safe. Second, you don't know if it will get you a trip to the police station right then and there. How many go out prepared to do that? Thirdly, let's say you decide to press a formal complaint. It's your word against an officer and even if you have "proof" it looks like you are trying to entrap them. After that, should you keep going with the complaint, you need to take the time out to investigate, research and go to court. Can you afford the lawyer? I can't. On a mountain top in western Mass.

The key isn't the border but rather what is contained within those borders.

Well honestly here in New Hampshire such things ARE tested all the time. And yes there ARE those that go out make sure our servants follow the law. That said, no, I do not have a trust fund that can facilitate a huge legal battle. However, look at some of the outter cities of Chicago that had handgun bans. They repealed them because they knew they were not defendable after the McDonald vs. Chicago case.
Sometimes all it takes is a spotlight shown on such practices to get them to stop. So, if Fed agents are violating civil rights we should be afraid to challenge it?? If thats the case then all IS already lost. I am not a lawer.Just my opinion.

I understand what you are saying. However, in the Chicago case, the defence for that and the pursuit of the legalities were done for FREE. The guy did not have to pay because people had been watching for this and jumped in to help, if he had, it wouldn't have gotten anywhere. What I'm saying is that because our legal system has gotten so expensive to navigate for the average person, most will just give in.
It's not right or fair, but that's the way it is. The next step will be open bribery like in second and third world countries. Something to be aware of and worry about! Most people can mount a minor protest, but it rarely does any good these days. You happen to live in an area where a protest by letters to the editor, letters to your local reps, and a visit to the court representing yourself, might actually work. BUT on the flip side, with so few people in your area, you will be known to the local cops and state police and will be a target for them to legally harass. I have friends still up there in LE and Corrections, and I know that you will be talked about and when possible, harassed. "That guy is out to get us" type of mentality...which is fair, since you would be thinking "those guys are out to get me". lol Life in small towns is wonderful, but everything has a flip side. Growing up way back when, we used to hop the border all the time on our sleds. The drinking age was lower in CA then. The funny part would be to watch them try and catch some crazed teenagers on sleds who have no fear. I think back about the speeds we pulled off and you couldn't pay me to do it now, bones take way longer to heal and body parts don't grow back anymore
I could cite many thousands of miles you could cross without any interference as long as you were traveling via sled, ATV or on foot, I'm sure you Mr.Bruce could also do so considering what some of the northern back country of NH is like.

On this point I will have to agree AND disagree with you. Yes, it is possible that if you stand up to illegalities or mistreatment or unconstitutional practices you MIGHT be"targeted" by law enforcement etc. That in and of itself should give anyone pause to think. A rogue LEO or polititian who gets the spotlight on the them will start to think hard about their practices. As for any of their compadres who stick up for any of the above practices are just as bad in my bock. Understanding our people who where badges or get elected to officer both did the same thing, THEY BOTH VOLUNTEERED for the job AND THEY BOTH SWORE AN OATH. I'm not saying those activities are as rampant as they are in poitics, but they do happen. Getting back on point though, I'll be searching for this mysterious power that has been beeing used by the FEDS. I want to see it in black and white. No memo, no post order, no "they said so"; just an authority granted by Congress.Thats what I want to see. Mr Bruce - just research the Patriot Act in it's entire length. It seems harmless since they are only looking for "bad guys" right? It has all kinds of interesting things in it.
